if the server or network provide some sort of IP masking like Quakenet or PTnet or Undernet... and for some stupid reason
user that has already masked IP by server, gets traced by "fbi" for some bad things made.... but they need like users ip to really trace him... and craps... are the network admins forced to give to the authorities users real ip or they dont if they dont want to IF the network is free like efnet (free = where anything can be done of illegal thing) ?

I really don't understand what your question is, but I think you are asking if networks are required to give out your real IP address if asked about illegal activities. I cannot speak for the networks, or the legal issues, but I DO know that even though your IP is masked, if you take part in a DCC Chat or a DCC transfer the person on the other ehd of the DCC connection automatically gets your IP address (unmasked). Kinda makes masking a moot point, don't it? wink

2. masking is good, coz u will do dcc only to known persons
(atleast i do) and it prevents someone to ddos me or whateva they do this days....

Yes.

Firstly, it is theoretically the duty of all citizens to help the authorities resolve cases of criminal behaviour. To know that you have useful information and to deliberately withhold it is an offence in its own right in most jurisdictions.

Secondly, where there are also legal instruments - including subpoenas - which can force the release of even business/company/client confidential material to a court or to the authorities.

i will have to disagree. if you notice on the motd of most servers. they make mention that when you connect to the irc server you are agreeing with the terms of use/AUP of that server or / network.

besides. hows the fbi going to get YOUR IP.

its a shaky subject. i mean. there are only few things the fbi can control. especially when it comes to IRC. controlled things such as pedophiles setting up meetings with a 16 yr old girl somewhere.

so in my opinion and from what i have gathered from my classes in law and justice. you do not have to give the fbi or anyone any sort of information on any user connecting to a network/server

They ask the network for its logs, which will record your IP when you join. If the network refuses, they get a court order that FORCES the network to hand over the logs. Easy.

If you turn out to be using a bouncer, they contact the shell admins and do the same thing.

I don't know what law and justice classes you've been attending, but this is VERY basic.

Besides which... when asked, most networks will probably supply such information even if they are not obliged to do so. Why? Because they don't like paedophiles either, or because they don't want the unnecessary attention and legal bills that will arise from picking a fight with law enforcement. Like it or not, this is the real world.

You think it "sux" that someone would provide help to catch pedophiles or those engaged in illegal activities or causing harm to others? Well, gee, here's a thought: how about just not doing whatever you wouldnt want to get caught doing?

what if for some reason u dont have logs for the network in question? (side thought)

and some crackers for the brain. you need to be careful who you trust when it comes to the FBI actually coming to a network. usually its someone who is using a vhost/bouncer/or a spoof. so always ask for proof of who they say they really are. and be especially careful when they ask for IRCop status for monitoring purposes. smile

Completely off topic, but he was referring to pedophiles (that's 45 year olds or so) having sex with 16 year olds - insinuating the general topic of the dangers of meeting people offline from online. I'm sure you've come across it in the media at some point.

Out of personal preference I don't think that particular subject needs to be discussed any further, it's disgusting, inappropirate and irrelevant.
