If the window isn't opened, it opens the query window minimized.

The problem is when the window is already opened, if it isn't minimized(even if it's active) it minimizes it.

That sounds like desirable behavior to me. Why are you using the "-n" switch if you don't want the window to minimize?

I play a few IRC RPG games, inwhich timers/scripts trigger.
i use "/query -n" so I'm talking on another channel when the commands go active the window doesn't interfere with what I'm typing.

Also, the help file is misleading:
Quote:
If the -n switch is specified, the window is opened in a minimized state.

While the helpfile could be more precise, why not use /query $iif(!$query(<nick>),-n) <nick>

I have to agree with Horstl. Make your script do a check if you don't want it to minimize when you use -n if it's already opened. -n functions the way I believe it should. -n is used in most (all?) commands that have it to minimize the window whether it's already opened or not and it should remain that way. It's up to you to script it if you want it to function differently in a specific situation.
