I request that some UI be displayed indicating that a privmsg has not properly been delivered if this condition can be reliably inferred.

Some networks refuse to deliver privmsgs to users that are not registered (ex. freenode). Other servers support server-side ignore. Perhaps the behavior should be consistent with the user-experience of trying to send messages to a moderated channel?

mIRC only relays messages from the server, it does not wait for a reply of success or failure when a message is sent. When you try to send a message to a moderated channel and you're not opped or voiced, the server sends a raw 404 error message which says the message cannot be sent to the channel. The ones you should be talking to are the coders of the IRCd's of these networks asking them to make the server send an error message in these situations, otherwise mIRC has no way of knowing whether the message was delivered successfully or not.

mirc generated a standard with respect to colours, why not try it here too?

this is not a standard that can be set without the help of a server, as rock mentioned. for colours it was relatively easy to hack the IRC protocol into accepting control codes in messages. in this case, mIRC will never know if the server passed the message onto the channel.. think about it, how would mIRC know if the message got through? It's like yelling into a dark cave and getting no reply and trying to figure out a way you can guarantee someone inside the cave heard you by yourself, without a reply from someone inside the cave
